TERMS & CONDITIONS
Preamble
These general conditions of sale are agreed between Pedro Jorge Custódio de Sá Pereira, operating in Edifício StartUp - Parque Empresarial da Baía do Tejo, Rua 2, Edifício n.º 23, 2830-302 Barreiro, NIF: 260633194, hereinafter referred to as “Seller” and people who wish to make purchases through the website www.nfcify.com, hereinafter referred to as “Consumer”.
The parties agree that purchases made through the website www.nfcify.com will be governed exclusively by this contract to the exclusion of any conditions previously available on the website.
1. COMMERCIAL POLICY
1.1 Seller Pedro Jorge Custódio de Sá Pereira has products for sale on the website www.nfcify.com (hereinafter referred to as “site” or “portal”). The seller's identification is as follows:

1.2 The Consumer indicates the individual who acts as a natural or legal person.
1.3 The Seller reserves the right not to process orders received from users who are not “Consumers” or those who do not comply with the general sales conditions at www.nfcify.com.
1.4 These general conditions and terms of sale exclusively regulate the offer, transmission and acceptance of orders placed on www.nfcify.com between the Consumer of the online store www.nfcify.com and the Seller.
1.5 The Consumer must provide the Seller with an email address, or details relating to another form of contact, that are correct and complete and accepts that the Seller can contact him using these details.
2. ORDERS
2.1 To order at www.nfcify.com, the CONSUMER must have an email account and their browser must be configured to accept cookies and pop-ups, in order to allow them to take advantage of all the website's navigability conditions.
Placing an order at www.nfcify.com is easy:
• Find the products you want to purchase;
• Add selected products to the shopping cart;
• Complete the purchase;
• Select the payment option;
• Review your order;
• Proceed to payment and confirm the order;
• Receive an order confirmation by email.
Your order is submitted when you select the “Confirm Payment" (Checkout) button at the end of the purchase process, so you must confirm your details and your shopping basket, as we may not be able to amend your order after this step.
In the event that we are unable to accept your order, we will send you an email to the email address you used to place the order with an explanation of the problem that may have arisen.
If the order is successful, an order confirmation will be sent to your email with details regarding the order.
We reserve the right not to accept your order, or to cancel it even after automatic confirmation.
By submitting the order form, you accept the general purchase conditions, as well as other conditions existing at www.nfcify.com, through links, including the general terms and conditions of use.
NFCify may not process orders that do not have sufficient guarantee of good collection; when orders are incomplete or incorrect, or the products ordered are no longer available. In the aforementioned cases, we will inform you by email that the sales contract was not concluded and that NFcify did not proceed with the sale, specifying the reasons for this.
If an order and payment have been made for products that are no longer available, NFCify will refund the money paid for the unavailable items.
2.2 Right not to accept the order or cancel the purchase
NFCify reserves the right to refuse any order for any reason. NFCify also reserves the right to cancel any purchase (even if it has already been accepted), (among others) in the following situations, exempt from liability for any damages or costs:
• The product is no longer available / in stock;
• Billing information is not correct or verifiable;
• The order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
• The transfer for payment of the order was not received by NFCify within 5 days after accepting the order;
• If NFCify considers you to be under 16 years of age;
• If NFCify considers you to be a reseller;
• Delivery to the address provided is not possible.
2.3 Data verification
After receiving the order, NFCify may carry out some checks on it before we prepare it.
These checks may include address verification, credibility, and fraud checking. Regarding fraud checking, NFCify performs partially automated checks on all orders to filter out transactions that are unusual, suspicious or identified as susceptible to fraud. Suspected fraud may be investigated and, if necessary, prosecuted. By confirming your order, you agree to these conditions.
3. GUARANTEES AND PRODUCT PRICE INDICATION
3.1 Payment Methods
On the nfcify.com website, the Seller offers the Consumer the following payment methods:
•Bank transfer
We do not accept any other payment methods other than those mentioned. Do not attempt to pay by any means other than those specified. If you do so, NFCify cannot be held responsible for lost payment or any other damages that may arise therefrom.
3.2 Payment processing
If you pay by Credit/Debit Card, we will deduct the amount due from your account. In the case of payment by Credit/Debit Card, all details (e.g. card number or expiration date) will be sent via encrypted protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by NFCify, except to carry out the necessary procedures for the purchase or refund, in the case of a return, in accordance with the exercise of the right of return or to report cases of fraud to the police. The purchase price of the products and shipping costs, as indicated on the order form, will be charged to your current account when the purchased products are prepared for shipping.
4. ORDER SECURITY
4.1 Your payment information will be encrypted from the moment you enter until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. NFCify cannot be held responsible for any damage suffered as a result of the use of electronic means of communication, including, but not limited to, recurring damages from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or software programs. computer used for communications or virus transmission.
Payments can only be processed if the information to be used for billing can be verified.
5. RESERVATION OF PROPERTY
NFCify retains ownership of the company's products until it has received full payment for all such products.
6. PRICES
6.1 The prices of products displayed on the website contain/include Added Value (VAT). Shipping fees apply per order. The exact price of the shipping fee may depend on the country where your order will be delivered. For additional information on shipping rates by country, see the Help/FAQ's section of the website.
6.2 Prices are all quoted in euros. Please note that changing the country of delivery may have an influence on prices due to transport costs.
6.3 Your total price
The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted upon order confirmation, which you can print or download for future use. Please only pay the exact amount specified in your order confirmation and make individual payments per order.
6.4 Price changes
The prices of products presented on the website are subject to change. NFCify reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
6.5 Pricing errors
Please note that even though the website is updated with extreme care, it is possible that the price information on the website contains errors. NFCify is not committed to the offer displayed and reserves the right to cancel your order if such an error occurs.
7. QUALITY & GUARANTEE
NFCify does not sell second-hand, defective products or products of lower quality than those currently on the market. The main features of each product presented at www.nfcify.com can be found on each product page.
Products offered for sale on www.nfcify.com may not exactly correspond to the actual product in terms of image and colors, due to the Internet browser and monitor used.
8. SHIPPING & DELIVERY
8.1 Delivery: where and when
NFCify ships products from Monday to Friday. Does not ship on certain holidays. You can only deliver an order if the delivery address is a home or office located in one of the countries mentioned in the list of available countries.
To receive the order, you must ensure that someone is at the address. This service does not include scheduling or booking options, meaning delivery of the order will be made without prior contact from the carrier. We do not guarantee deadlines during promotions, sales, Christmas and out-of-stock periods.
8.2 Delivery times
NFCify will not be responsible for non-compliance, or delay in compliance, with any obligation that is due to an event of force majeure, that is, an event, act or omission, beyond its reasonable control. Force Majeure Event includes any event, act or omission, beyond the reasonable control of NFCify.
NFCify undertakes to attempt to deliver on time, to the extent that this is commercially reasonable.
8.3 Partial Deliveries
Whenever possible, NFCify will try to deliver everything in one shipment. However, NFCify reserves the right to split delivery of the order, for example (but not limited to) if a part of the order is delayed or unavailable. In the event that NFCify will divide the order, the customer may be notified, by email, of the intention to proceed in this way. For this purpose, the email address provided by the customer at the time of purchase will be used.
8.4 Inspection upon delivery
At the time of delivery, the CONSUMER must inspect the packaging to check for any damage. If the products are found to be damaged, the CONSUMER should not accept delivery of the order, which will be returned.
Any complaint about non-receipt of an order must be made within a maximum period of 14 days from the date of placing the order.
NFCify cannot be held responsible for its loss.
9. SHIPPING FEES
9.1 Shipping fees apply per order. The exact price of each shipment may depend on the country of delivery. For more details on shipping prices by country, please see the FAQs/Help section of the Website.
10. RETURNS
10.1 Product exchange
NFCify does not carry out exchanges and cannot be held responsible for any loss or damage caused by not exchanging products.
10.2 Returns
Given the personalized nature of the products, NFCify does not provide returns. Under the terms of Decree-Law no. 24/2014, of 14 February, applicable to contracts concluded remotely, the user has the right to freely terminate a new contract, without giving a reason, within 14 days from the day the conclusion of the contract (in the case of services) or the day on which the user received the order.
Pursuant to Decree-Law No. 24/2014 of February 14, there are exceptions to the right to free resolution:
“1 – Unless the parties agree otherwise, the consumer cannot freely terminate contracts for: ”

“c) Supply of goods made according to consumer specifications or clearly personalized;

“i) Its execution begins with the prior and express consent of the consumer; It is
ii) The consumer acknowledges that their consent implies the loss of the right to free resolution;”
Therefore, any good produced according to the consumer's specifications is excluded from the right to terminate the contract, that is, personalized products or products made according to the consumer's specifications. In the case of personalized products, if for any reason you are not satisfied, you must send an email to [email protected] so that the complaint can be analysed and properly handled.

12. CONDITIONS APPLICABLE TO PROMOTIONAL CODES (DISCOUNT)
12.1 When used in accordance with the established rules, a promotion code entitles the CONSUMER to take advantage of a promotion/discount relating to the purchase of a specific product or a set of products, during the period indicated/associated with the promotional code/promotional campaign.
12.2 Promotional codes can be used for online purchases made on the website of the country where the code was issued. The sale, exchange or donation of a promotional code is not permitted. The CONSUMER holding the promotional code cannot upload or make a promotional code available on any website or other public form of offer, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.
12.3 The promotion code is connected with the NFCify brand. The use of the promotional code in connection with another brand, company or name is not permitted. The use of the promotional code in an illegal, abusive or disrespectful manner, as well as in any other way that could harm NFCify's reputation, is also not permitted.
12.4 The use of the promotional code is subject to only one use per product and per order. Promotional codes cannot be combined with any other promotions or special offers.
12.5 Promotional codes are not exchangeable for money.
12.6 NFCify has no obligation to reissue or refund promotional codes.
12.7 Without prejudice to any other rights, NFCify has the right to immediately invalidate the promotional code if it has reason to suspect that a promotional code is being used: in violation of the aforementioned assumptions, for usurpation or in other cases in which NFCify has reason to do so.
13. AVAILABILITY
Fulfillment of all orders placed on the website is subject to availability. NFCify tries to ensure that all items available on the website are in stock. However, NFCify reserves the right not to accept any orders or cancel orders already confirmed for products that are no longer in stock. In these cases, NFCify may inform the CONSUMER of this fact and will refund the amount paid.
14. VALIDITY OF THE PROMOTION
Offers on the website are only valid for the moment they are displayed on the website, unless information to the contrary is communicated on the website. NFCify is not bound to any offer if there are errors or mistakes in spelling, prices or other errors in the information on the website. NFCify reserves the right to cancel any purchase and sale made under such errors.
15. RESPONSIBILITY
15.1 NFCify will only be responsible for damages suffered by the customer in the event that such damages result from violations attributable to NFCify's contractual obligations to the CONSUMER, or in the event that NFCify's liability results from applicable legislation.
15.2 If the customer has suffered damage related to website activity, NFCify's liability will be limited to:
• Damage to NFCify products or other materials;
• Reasonable and demonstrable costs incurred by the client to find the cause and amount of compensation attributable to the damage;
The maximum reimbursement of the aforementioned compensation will be (if applicable) the price of the products in question.
15.3 NFCify cannot be held responsible for damages suffered by third parties resulting from the use of any of our products. NFCify cannot be held responsible for damages suffered by the CONSUMER as a result of the use of our products.
15.4 NFCify is not responsible for damages resulting from incorrect information on the website.
16. APPLICABLE LAW
These general conditions and all emerging disputes that are related to these general conditions, including their validity, the use of the website or any purchase on it must be governed by Portuguese Law.
17. CHANGES TO TERMS AND CONDITIONS
NFCify has the right to change these Terms & Conditions at any time without prior notice. The CONSUMER is subject to the principles and terms in force at the date of their order.
18. INFORMATION ON THE SITE
Although NFCify checks its website carefully, the information, text, graphic documents, films, music and/or other services may contain errors or be incomplete or incorrect. NFCify will not be liable for any damages resulting from the use (or inability to use) the site, including damages caused by viruses or any inaccuracy or incompleteness of the information.
19. SITE TRADEMARKS AND COPYRIGHT
All brand names, product names and titles used on the site are trademarks or registered names of NFCify or trademarks and registered names of other holders. The CONSUMER of the website is not authorized to use or reproduce any of these trademarks or registered names, as this constitutes a violation of the rights of the holders.
Everything concerning the design, texts, documents, films, music and/or other services of the website, the selection and organization thereof, as well as the entire compilation of the software and all other materials on the website are the property of NFCify and its suppliers. CONSUMERS are authorized to electronically copy and print portions of the Website only as necessary to place an order on it or to use the Website as a purchasing source. The CONSUMER is not authorized to make any other use of the website or the information and materials contained therein, including reproduction for purposes other than those mentioned above, modification, distribution or republication. If the CONSUMER wishes to use information or materials from the website, he or she must obtain prior written authorization granted by NFCify.
20. INTELLECTUAL PROPERTY
NFCify owns all intellectual property rights in the website and the material published on it. These materials are protected by copyright laws valid worldwide.
Permission is granted to temporarily download one copy of the materials (information or software) on NFCify's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials use them for any commercial purpose or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on NFCify's website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. This license will automatically terminate if you violate any of these restrictions and may be terminated by NFCify at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
